Employer Terms and Conditions
The services available at the employme.com web site (the “Site") are provided by Employme.com Limited, which has its main place of business at employME.com Limited, 4 Park Circus Place, Glasgow G3 6AN ( "employme.com" "We" Us").
Your use of the services available at and through the Site ("Services") is subject to both the Web Site Terms and the terms of this Employer Agreement set out below (collectively “the Terms”). The terms of this Employer Agreement will take precedence over the Web Site Terms if there is any conflict or ambiguity between them.
Please read the Terms carefully. By registering on the Site and using the Services you accept and agree to be bound by the Terms. If you do not agree to these Terms, you are not entitled to register on the Site and use the Services.
We reserve the right to amend the Terms at any time. We will post any changes to the Terms on the Site and the changes will be effective once published on the Site. You accept that your continued use of the Site after any change indicates your acceptance of that change.
Conditions of Registration
By registering on the Site and using the Services you warrant that you are either a UK limited company or a VAT–registered business which operates at the locations covered by the Site.
The Services
We provide a service which enables people seeking part-time or temporary work ("Jobseekers") to make their details available to businesses looking to hire part-time or temporary staff ("Employers") on the Site.
When you register on the Site, We will add your details to our searchable database of Employers ("Database"). The Database will be accessible on the Site, and the following details will be made available to users:
- the job title and employer identity
- the location (by reference to city only)
- a brief description of the vacancy
- the closing date for applications
Jobseekers who have registered with Us will be able to search the Database, view the above details and apply for available positions.
If a Jobseeker wishes to be considered for a position posted by you, we will send you an e-mail or SMS (where you have provided a mobile phone number) to notify you of this. It is then your responsibility to contact the Jobseeker if you wish to progress their application. Please note that We will not contact the Jobseeker on your behalf.
On condition that you have registered with the Site and have paid the Registration Fee (as defined below), you will be able to search the Database to view details of Jobseekers. If you wish to consider a Jobseeker for a position, you should click the box next to that Jobseeker's details. We shall send that Jobseeker an email and/or SMS with your contact details and it will then be the Jobseeker's responsibility to contact you.
Our Role
Employme.com is
not a recruitment agency and you acknowledge and agree that:
- We do not act as an agent for the Jobseeker nor do We act as your agent.
- We will not act as an intermediary between you and any Jobseeker, and you acknowledge and agree that We will not enter into correspondence or discussions or negotiations with any Jobseeker on your behalf.
- We make no warranties or representations in respect of the quality or honesty of any Jobseeker or their ability properly to perform any activities associated with any positions placed on the Site.
We do not vet or run checks of any nature on Employers or Jobseekers who register on the Site nor do We verify the legitimacy or accuracy of the information provided to Us by Employers or Jobseekers. As a result, We cannot and do not accept any liability for any information included in the Database or on the Site, nor for any use or reliance you may make of or put on it except as specifically agreed with Us in any further agreement We may make with you in writing.
You acknowledge that in providing you with Jobseekers' information we are not endorsing or recommending the Jobseeker nor making any warranties or representations in relation to them.
We will not become involved in any dispute which may arise between a Jobseeker and an Employer in respect of a job vacancy or position, including (without limitation) any dispute about the type of work or pay. We cannot advise you on issues of employment law and you should consult a suitably qualified lawyer if you have any specific legal questions or problems. If, however, you have any legitimate concerns or complaints about a particular Jobseeker or his or her activities, please direct these to employme.com at the contact details set out on Our Contact Us page.
Registration
To use the Services, you should complete the on-line registration form on the Site and submit all compulsory fields. Admission as a registered user of the Site is also conditional on payment by you of the appropriate registration fee (details of which can be found on the Site) ("Registration Fee").
Once you have submitted your details, an e-mail will be sent to you confirming your Employer ID and successful registration, and providing you with a password.
Please note that You are also responsible for any costs and expenses incurred by you in accordance with the use of the Services including, without limitation, any telephony costs or charges for other communications services.
Employer Details
On registration you will be asked to provide certain information to enable you to use the Services. All personal data will be processed in accordance with Our Privacy Commitment.
In order to use and gain benefit from the Services, you must provide Us with correct and up-to-date details. You warrant to Us that the details which you provide on registration are correct.
Your details will be stored in a unique "Profile", which you will be able to access (using your Employer ID and password) and amend at any time. You are responsible for keeping the personal information in your Profile correct and up to date. If your details change, you undertake to update your Profile as soon as reasonably possible.
Employer ID and Password
Your Employer ID will be your e-mail address. Your password will be as initially allocated by Us, but you can change your password at any time on the Site. You are responsible for keeping your password secret and secure. You must not disclose your password to anyone else nor allow anyone else to log in to the Site using your Employer ID and password.
If for any reason you are unable to access your Profile or have forgotten your password, please notify Us at info@employme.com
Use of the Services
You may not reproduce, publish, copy, distribute, modify, transmit or use the information and materials on the Site for any purposes other than those set out in the Terms.
You warrant that you will not:
- use the Site or the Services for any illegal purpose or in any manner inconsistent with the Terms, applicable law or the Privacy Commitment; or
- include any material on the Site which is obscene, indecent, unlawful or defamatory, nor material which infringes the privacy, confidence or intellectual property rights of any third party.
You hereby indemnify Us and keep Us indemnified against any and all claims, damages, losses, liabilities and costs arising from and in connection with your use of the Site and/or the Services or your breach of the Terms.
Warranties and Liability
To the extent permitted by applicable law, We make no warranties, representations or undertakings that the Site or any material within or sent through the Site, will be free from viruses or other defects. We recommend that you take your own precautions to ensure that whatever you receive from Us through this Site is free from computer viruses or other defects.
Whilst We will deliver the Services with reasonable skill and care, all warranties and representations, express or implied, statutory or otherwise (including, but not limited to, warranties of satisfactory quality, accuracy, fitness for a particular purpose and of non-infringement of the rights of a third party) are hereby excluded to the extent permitted by law.
We will not be liable for any loss, damage, expense, cost, delay or other liability whatsoever which you may incur as a result of any event beyond our reasonable control (including without limitation any failure of transmission, communication, computer or other facilities or your inability to access the Site for any reason or any failure, error or delay in the sending or receiving of any notice or communication or instruction whether through the post, by e-mail or SMS or any other electronic medium). In no event will We be liable to you for loss of profits, loss of data, special, indirect or consequential losses.
To the extent that We are found to be liable to you under the Terms, Our entire liability and your exclusive remedy for damages will be limited to the sum of all Registration Fees paid to us or £1,000, whichever is the higher amount.
Nothing in the Terms shall limit or exclude Our liability to you for death or personal injury resulting from any act, omission or negligence of Us or Our employees, or any other liability the exclusion of which is expressly prohibited by statute.
Termination
Without limiting Our other remedies, We reserve the right to suspend or cancel your right to use the Site and/or the Services at any time and for any reason including (without limitation) where:
- you are in breach of the Terms or where We have reasonable grounds to believe that you have breached these Terms, including, without limitation, where you fail to pay the Registration Fee when due; or
- you attempt to access systems to which access has not been granted; or
- you undertake any activity which violates any applicable law, including any law governing the collection, use or disclosure of personal information, or which compromises the privacy of other users and their personal data or information.
On termination, all of the information that you have placed on the Site will be removed. You will not be entitled to re-register on the Site without our prior consent.
You may ask to be withdrawn from the Database at any time by sending Us an e-mail at info@employme.com or writing to Us at employME.com Limited, 4 Park Circus Place, Glasgow, G3 6AN.
Jurisdiction
The Terms are governed by Scots law. Any dispute arising out of the Terms or your use of the Site or the Services will be subject to the non-exclusive jurisdiction of the Scottish Courts.
General
Any communication sent electronically by email or otherwise will be deemed to have been sent once it enters a system for generating, sending, receiving, storing or otherwise processing electronic communications ("Information System"), and will be deemed to have been received by you at the time that in a readable form it enters an Information System which is capable of access by you.
If any provision of these Terms is held to be unlawful, void, or unenforceable, then that provision will be severed from these Terms and will not affect the validity and enforceability of the remaining provisions.
No failure or delay by Us in exercising Our rights under the Terms will be deemed to be a waiver of that right, and no waiver by Us of any breach will be considered as a waiver of any subsequent breach.
The Terms, together with the Privacy Commitment constitute the entire agreement between employme.com and you in respect of the Site and the Services.
All rights not expressly granted in these Terms are reserved to employme.com.
