Job Hunter Agreement

The services available at the employme.com web site (the “Site”) are provided by Employme.com Limited, which has its main place of business at employME.com Limited, 4 Park Circus Place, Glasgow, G3 6AN ("employme.com" "We" Us").

Your use of the services available at and through the Site ("Services") is subject to both the Web Site Terms and the terms of this User Agreement set out below (collectively “the Terms”). The terms of this User Agreement will take precedence over the Web Site Terms if there is any conflict or ambiguity between them.

Please read the Terms carefully. By registering on the Site and using the Services you accept and agree to be bound by the Terms. If you do not agree to these Terms, you are not entitled to register on the Site and use the Services.

We reserve the right to amend the Terms at any time. We will post any changes to the Terms on the Site and the changes will be effective once published on the Site. You accept that your continued use of the Site after any change indicates your acceptance of that change.

Conditions of Registration

To register on the Site and use the Services (a) you must be 16 years of age or older, and (b) you must be eligible to work in the UK. By registering on the Site you warrant to employme.com that you are aged 16 or over and that you are eligible to work in the UK.

Not all job vacancies which may be advertised on the Site will be available to those aged 16 and/or 17. Where this is the case, the job advertisement will make it clear that that applicants must be aged 18 or older. You must take note of any conditions which may be attached to any job vacancies advertised on the Site.

The Services

We provide a service which enables people seeking part-time or temporary work ("Candidates") to make their details available to businesses looking to hire part-time or temporary staff ("Employers") on the Site.

When you register on the Site, We will add your details to our searchable database of Candidates ("Database"). The Database will be accessible on the Site but only the following details will be made available to users:

Employers who have registered with Us will be able to search the Database, view the details as set out above and indicate if they are interested in speaking to you about positions which they may have available.

If an Employer chooses to interview you, We will send you an e-mail or SMS (where you have provided your mobile phone number) to notify you of this. It is then your responsibility to contact the Employer if you are interested in the position and it is your decision whether or not to contact the Employer. Please note that We will not contact the Employer on your behalf and We will not disclose your contact details to the Employer.

Our Role

Employme.com is not a recruitment agency and you acknowledge that:

We cannot advise you on issues of employment law and you should consult a suitably qualified lawyer if you have any specific legal questions or problems. Any information contained on the Site is general information only and nothing on the Site can be construed as advice on legal or employment issues.

Registration

In order to use the Services, you need to complete the on-line registration form on the Site and submit all compulsory fields. Once you have submitted your details, an e-mail will be sent to you confirming your User ID and successful registration, and providing you with a password.

There is no fee payable to Us for registration on the Site or for use of the Services. You will, however, be responsible for any costs and expenses incurred by you in accordance with the use of the Services including, without limitation, any telephony costs or charges for other communications services.

We do not vet or run identity checks on Candidates who register on the Site nor do We verify the legitimacy or accuracy of the information provided to Us by Employers or Candidates. As a result, We cannot and do not accept any liability for any information included in the Database or on the Site, nor for any use or reliance you may make of or put on it except as specifically agreed with Us in any further agreement We may make with you in writing.

Personal Details

On registration you will be asked to provide certain information about yourself to enable you to use the Services. All personal data will be processed in accordance with Our Privacy Commitment.

In order to use and gain benefit from the Services, you must provide Us with correct and up-to-date details. You warrant to Us that the details which you provide on registration are correct.

Your details will be stored in a unique "Profile", which you will be able to access (using your User ID and password) and amend at any time. You are responsible for keeping the personal information in your Profile correct and up to date. If your details change, you undertake to update your Profile as soon as reasonably possible.

Employers

Employers will include various businesses from a range of market sectors, and could include individual companies and recruitment agencies. Whilst We will use Our best efforts in good faith to check that Employers who register with Us are legitimate businesses, you acknowledge that by providing you with an Employer's details, We are simply providing you with a point of contact and are not endorsing or recommending the Employer nor making any warranties or representations about the Employer's business activities or any job vacancy which is claimed to be on offer. We would ask you to use common sense and exercise normal caution when making arrangements to visit or meet with Employers.

We will not become involved in any dispute which may arise between a Candidate and an Employer in respect of a job vacancy or position, including (without limitation) any dispute about the quality of work, availability of hours or pay. If, however, you have any legitimate concerns or complaints about a particular Employer or his activities in connection with the Services and the Site, these can be directed to employme.com at the contact details set out on Our Contact Us page.

Updating the Site

Each week you will be sent an e-mail or an SMS (where you have provided your mobile number) asking you to renew your Profile and indicate whether you wish to remain "active" on the Database for the following week, i.e. that you still wish to be contacted by Us regarding Employers.

If you are flagged on the Database as unavailable, you will not be contacted about Employers until your Profile has been reactivated. This can be done by you at any time. In the event that your Profile has been dormant for 12 months, your details will be deleted from the Database.

We will update the Site on a weekly basis and whilst We will do our best to ensure that the information on the Site up to date, We will not be liable to you or to any other party for any delays, errors or omissions in doing so. You acknowledge that you are responsible for ensuring that your details on the Database are up to date.

User ID and Password

Your User ID will be your e-mail address. [Your password will be as initially allocated by Us, but you can change your password at any time on the Site.] You are responsible for keeping your password secret and secure. You must not disclose your password to anyone else nor allow anyone else to log in to the Site using your User ID and password.

If for any reason you are unable to access your Profile or have forgotten your password, please notify Us at info@employme.com

Use of the Services

You may not reproduce, publish, copy, distribute, modify, transmit or use the information and materials on the Site for any purposes other than those set out in the Terms.

You warrant that you will not:

To the extent permitted by applicable law, We make no warranties, representations or undertakings that the Site or any material within or sent through the Site, will be free from viruses or other defects. We recommend that you take your own precautions to ensure that whatever you receive from Us through this Site is free from computer viruses or other defects.

Termination

Without limiting Our other remedies, We reserve the right to suspend or cancel your right to use the Site and/or the Services at any time and for any reason including (without limitation) where:

You will not be entitled to re-register on the Site without our prior consent.

You may ask to be withdrawn from the Database at any time by sending Us an e-mail at info@employme.com or writing to Us at employME.com Limited, 4 Park Circus Place, Glasgow, G3 6AN.

Warranties and Liability

Whilst We will deliver the Services with reasonable skill and care, all warranties and representations, express or implied, statutory or otherwise (including, but not limited to, warranties of satisfactory quality, accuracy, fitness for a particular purpose and of non-infringement of the rights of a third party) are hereby excluded to the extent permitted by law.

We will not be liable for any loss, damage, expense, costs, delays or other liability whatsoever which you may incur as a result of any event beyond our reasonable control (including without limitation any failure of transmission, communication, computer or other facilities or your inability to access the Site for any reason or any failure, error or delay in the sending or receiving of any notice or communication or instruction whether through the post, by e-mail or SMS or any other electronic medium).

To the extent that We are found to be liable to you under the Terms, Our entire liability and your exclusive remedy for damages will be limited to the sum of £1,000.

In no event will We be liable to you for loss of profits, loss of data, special, indirect or consequential losses.

Nothing in the Terms shall limit or exclude Our liability to you for death or personal injury resulting from any act, omission or negligence of Us or Our employees, or any other liability the exclusion of which is expressly prohibited by statute.

Your Liability

You hereby indemnify Us and keep Us indemnified against any and all claims, damages, losses, liabilities and costs arising from and in connection with your use and abuse of the Site and/or the Services or your breach of the Terms.

Jurisdiction

The Terms are governed by Scots law. Any dispute arising out of the Terms or your use of the Site or the Services will be subject to the non-exclusive jurisdiction of the Scottish Courts.

General

Any communication sent electronically by email or otherwise will be deemed to have been sent once it enters a system for generating, sending, receiving, storing or otherwise processing electronic communications ("Information System"), and will be deemed to have been received by you at the time that in a readable form it enters an Information System which is capable of access by you.

If any provision of these Terms is held to be unlawful, void, or unenforceable, then that provision will be severed from these Terms and will not affect the validity and enforceability of the remaining provisions.

No failure or delay by Us in exercising Our rights under the Terms will be deemed to be a waiver of that right, and no waiver by Us of any breach will be considered as a waiver of any subsequent breach.

The Terms, together with the Privacy Commitment constitute the entire agreement between employme.com and you in respect of the Site and the Services.

All rights not expressly granted in these Terms are reserved to employme.com.
